    I/We hereby request credit to be extended to the above referenced company (The Customer). I/We understand that the above information is for the use of the credit department of Granite State Plumbing & Heating, LLC and that all credit references may be contacted to obtain personal and business credit information. Signatures may be copied for the purposes of obtaining credit references. I/We agree that Granite State Plumbing & Heating, LLC may provide any such credit information to others without prior consent.

    The Customer promises to pay all debts arising out of this extension of credit. The Customer agrees (a) that all balances are due in full 30 days from the date of invoice; (b) that accounts not paid within 30 days incur a charge of 2% per month (24% APR), except where applicable law prohibits said charge, in which event the finance charge shall be the maximum allowed by applicable law; (c) that if the account is turned over for collection, the 24% (or other applicable) annual percentage rate will continue if/when suit is filed and until the account is paid in full; (d) to pay costs of collection and reasonable attorney collection fees on this account in the event it becomes overdue.

    The Customer agrees that the terms set forth in this application as well as those on the Granite State Plumbing & Heating LLC, contracts, agreements and invoices govern all transactions between the parties. Inconsistent terms and conditions set forth in any document supplied by Customer shall be null and void and are hereby specifically rejected.

    The Customer agrees to notify Granite State Plumbing & Heating LLC in writing by certified mail, return receipt requested, no later than 30 days prior to any transfer of the ownership of the Customer. Regardless of the form of any such transfer, the Customer, any successor entity or person, and each guarantor hereof shall be jointly and severally liable to Granite State Plumbing & Heating LLC for all balances due and owing at the time of the transfer.

    This information is given for the purpose of obtaining credit and is certified and warranted to be true. NOTE: Unless you advise us otherwise in writing, all employees of your business are authorized to utilize this account.

    The undersigned acknowledges that each of the above representations, covenants, and waivers have been knowingly and voluntarily made and that
    each is a material factor in Granite State Plumbing & Heating LLC decision to extend credit.


    Personal Guarantee of Commercial Obligations

    In consideration of the extension of credit to the Customer, at my / our request, I/we hereby guarantee to Granite State Plumbing & Heating LLC (the Company), the prompt payment, when due, of every claim and debt of the above company to the Company. This guarantee is given by the undersigned in order to induce the Company to extend credit to the above named company.

    For myself, my successors, heirs and assigns, I/we hereby agree to pay the Company on demand, any sum which may be or become due to the Company. The personal joint and several liability of each of the undersigned is primary and shall not be affected by any discharge, extension of time, release of security, incorporation, merger, bankruptcy, transfer, reorganization or sale of Customer’s business. The obligation of each of the undersigned is immediate and the Company has no obligation to proceed against the Customer before first proceeding against the undersigned. The undersigned hereby waive(s) any notice of changes in terms and amount of extension of credit to the Customer , and waive(s) all suretyship defenses and rights of claims to homestead protection whether now existing or existing in the future, and recognize(s) that this guarantee is a personal and unconditional liability.

    The individual guarantee is continuing and may only be revoked prospectively. Any such revocation must be signed and in writing, and is effective when received by the Company
